Zusammenfassung
“Gerechtigkeit”, sagt Rawls, “ist die erste Tugend von Institutionen, so wie es Wahrheit von Wissenssystemen ist” (Rawls 1971: 3; meine Übersetzung). Der Kontext, in dem dieser Satz steht, macht deutlich, daß Rawls für ihn keinen Anspruch auf empirische Wahrheitsgeltung erhebt, so wie man das für erfahrungswissenschaftlich gewonnene Tatsachenbehauptungen tut. Sondern er will damit sagen, daß wenn Institutionen einer normativen Beurteilung unterzogen werden, Gerechtigkeit der oberste Bewertungsmaßstab ist, daß vorhandene Institutionen oder institutionelle Ordnungen, soweit sie einer Gerechtigkeitsprüfung nicht standhalten, zu verändern und ggf. abzuschaffen sind, und daß bei der Schaffung neuer Institutionen dem Gesichtspunkt der Gerechtigkeit Vorrang vor allen übrigen Gesichtspunkten gebührt, die bei deren Gestaltung zu berücksichtigen sind. Es wäre deshalb verfehlt, aus der etwaigen Beobachtung, daß die Wirklichkeit vorhandener Institutionen oder institutioneller Praktiken keineswegs mit den Standards der Gerechtigkeit übereinstimmt bzw. nur unmaßgeblich von diesen inspiriert ist, einen Einwand gegen die Richtigkeit des oben zitierten Satzes ableiten zu wollen. Gerechtigkeit ist ein normatives Konzept, dessen Validität nicht dadurch in Frage gestellt wird, daß die Realität ihm nicht entspricht.
