Abstract
The wide ranging debate concerning a rise in punitivity in international criminal policy and practice has led to controversial findings. On the one hand, there is no doubt that a fundamental transformation of criminal policy has taken place. It has been claimed that in the case of the U.S. and England/Wales in particular, welfare-oriented policies have been increasingly diminished and replaced with policies of retribution, surveillance and imprisonment. Analyses conducted by David Garland (2001) or Loïc Wacquant (2010) have been broadly received in that regard. On the other hand, one matter which is still in dispute is the question of whether, or to what extent, there has also been a punitive turn outside of Englishspeaking countries (e. g., Pratt and Eriksson 2013). This article is meant to contribute to a clarification of how punitivity can be reconstructed and how relevant the transformations are that could occur outside of the English-speaking world.
