Abstract
This chapter gives a review of the juvenile delinquency, its causes, and the special criminal act for young offenders in Austria (a relatively small country in the middle of Europe, which is a member of the European Union).
The so-called Juvenile Court Act (Jugendgerichtsgesetz—JGG), which is adapted to the needs of young offenders, takes the difficulties associated with the adjustment to adulthood into account. As a Federal Act, it contains substantive and procedural regulations, including regulations on the enforcement of imprisonment, for juveniles (from 14 up to 18 years) and young adults (up to 21 years). The focus of the JGG is decriminalization and the protection of the young person during the proceedings. The sanctions possible under the JGG—especially, the alternatives to fines and imprisonment—and the rules to support the young suspect during the pre-trail stage as well as in front of the court are described. In addition, the specifics for young inmates in prison are analyzed. It is also shown that all these regulations and practices in Austria are in line with the UN Convention on the Rights of the Child.
