Abstract
The German reunification of 3 October 1990 following the fall of the Iron Curtain has had far-reaching social, economic, political and cultural consequences. One of the main purposes is to concentrate on the first federal election after the reunification as a litmus test showing the growing tension between the federal legislature and the German Constitutional Court over the control of the electoral system. Electoral codes provide a voting system combining proportional representation with simple majority voting, granting citizens two votes. Not only does the proportional nature of the German electoral system favour coalition governments, but it is also hardly compatible with electoral equality. Germany has experienced significant changes in the last decades including a move from a tri-partite system—the Christian-conservative (CDU/CSU), the liberal (FDP) and the liberal to left-wing (SDP)—to a more fragmented political spectrum with the emergence of the Greens (Die Grünen) and the establishment of the PDS (the former Socialist SED) as a regional party.
