Abstract
Der Beitrag stellt die die nicht rechtsverbindlichen Vereinbarungen der Europäischen Union mit Drittstaaten im Bereich von Asyl und Einwanderung in den Kontext der Informalisierung der „Global Governance“, vollzieht die Entwicklung der auswärtigen Migrationspolitik seit 2015 nach und ordnet sie als Phänomen eines verstetigten Krisenmodus ein. Auf der Grundlage ihrer dabei herausgearbeiteten Merkmale wird die informalisierte auswärtige Migrationspolitik sodann als Problem des EU-Außenverfassungsrechts mit Blick auf Kompetenzfragen, Verfahrensvorschriften, Rechtsschutzfragen und die Gefährdung der Einhaltung unionsrechtlicher und internationaler Verpflichtungen analysiert. Der Beitrag gelangt zu dem Fazit, dass die auswärtige Migrationspolitik trotz unionsspezifischer Besonderheiten als Ausdruck einer Normativität des „whatever works“ gesehen werden kann, die auch andere Bereiche informalisierter „Global Governance“ prägt und die eingehegt werden muss.
