Zusammenfassung
In einem der wenigen Hinweise auf andere Schriftsteller, die sich in Lockes berühmter Schrift über die bürgerliche Regierung finden, spricht er mit Hochachtung von Richard Hooker (1553–1600), den er verständig (judicious) nennt. In Deutschland wenig bekannt, gehört dieser Theologe mit zu den bedeutendsten Rechtsphilosophen der englisch sprechenden Welt. Wie Sir Thomas Smith (1514?–1577) ein Kind des Zeitalters der Königin Elisabeth, hat er in seinen Laws of Ecclesiastical Polity die thomistische Staats- und Rechtslehre für den anglikanischen Protestantismus umgedeutet und die Grundlage für einen gemäßigten, auf Tradition ruhenden Konstitutionalismus geschaffen. Die konkrete Gestalt dieses Konstitutionalismus hat dagegen in Sir Thomas Smiths De republica Anglorum oder „Über den Staat der Engländer“ ihren autoritativen Interpreten gefunden.
