In der sozialwissenschaftlichen Diskussion — auch und gerade der zur Globalisierung — ist es eine der zentralen Fragen, wie sich die Stellung des territorialen Nationalstaates im Zuge der Entwicklung weltweiter Zusammenhänge verändert.1 In dieser Debatte werden unter anderem Flüchtlinge als paradigmatische Figuren der transnationalen öffentlichen Sphäre angeführt (Fortier 1999: 41). Ihr Verhältnis zum Konzept des territorialen Nationalstaates angesichts von Globalisierungsprozessen bleibt jedoch ambivalent. Einerseits werden sie als Gefahr für das Konzept des territorialen Nationalstaates gesehen (Malkki 1990: 33, 1995: 9), als transmigratorischer Beitrag zu seinem Untergang (siehe bereits Arendt 1962: 402ff.). Dagegengehalten wird andererseits, sie unterstützten, als das notwendige Andere, den Fortbestand der Trinität von Bürger, Nation und Territorialstaat (Soguk 1999: 18). Flüchtlingsphänomene scheinen den modernen Nationalstaat als Konzept gleichzeitig zu unterstützen wie zu unterminieren, was von verschiedenen Autoren je unterschiedlich betont wird (Warner 2000).
