Zusammenfassung
Der Ausgangspunkt der vorliegenden Untersuchung war eine Unzufriedenheit mit der Literatur zur R2P, die zwar oftmals von einer neuen Schutznorm spricht, sie letztlich aber nicht in einen normtheoretischen Kontext setzt. Lediglich implizit ergibt sich über die vielfach formulierte Forderung nach einer effektiveren, möglichst materiell abgesicherten Verregelung eine Anknüpfung an die rationalistische Normenforschung. Diese besitzt allerdings gerade dort einen blinden Fleck, wo menschenrechtliche Normen wie die R2P ihren Verpflichtungscharakter beziehen müssen: bei normativen bzw. moralischen, prinzipiell geteilten Überzeugungen.
