Abstract
This chapter sets out the entirety of the jurisprudential literature review on consent-seeking in the Hanafī madhhab. The most unique aspect of this review chapter lies in the breakdown of Hanafī consent-seeking jurisprudence into ‘elements’ of consent-seeking (consent; shūrā/consultation, and wilāya/guardianship)—against which the empirical data on Pashtun consent-seeking is analysed in Chapters 5–7. To help orient the reader in the notion of Hanafī-specific law, this chapter begins with a general overview of sharī‘a (Islamic law) and its development into the doctrinal schools of thought, as well as a general overview of marriage from an Islamic legal perspective. To keep the primary focus of this book on consent-seeking from a religious legal perspective, the secular legal context is examined in the next chapter.
