Some Aspects of Criminal Law Assessment of Property Damage to Corporate Entities

Abstract

The purpose of this work is to consider complex issues of criminal legal assessment of the infliction of property damage to corporate entities, which are caused by deception or abuse of trust. In accordance with article 2, paragraph 1, of the Criminal Code, property is an important object of protection against criminal attacks. She is listed by the legislator, among the most important tasks and placed in second place, after the rights and freedoms of the individual, which emphasizes her importance. If we turn to the data of the judicial statistically, it should be noted that over the past few years in Russia criminal encroachments on property account for more than half of all recorded crimes (their share is about 55%). Despite this situation of affairs, indicators of property damage to corporate entities, committed through deception or abuse of trust in the general structure of attacks against property, occupy a small number. In 2019, 102 criminal cases were considered by Russian courts, under article 165 of the Criminal Code of the Russian Federation. However, such statistics do not reflect an objective situation of affairs, since the criminal assault in question is highly latent. Many criminal attacks, where the perpetrators use criminal attacks such as deception or abuse of trust, are often not registered. The methodological basis (methodology) of the article was the provisions of materialistic dialectics as a universal method of cognition. Such private methods as: formal-logical, system-structural, statistical, sociological. The theoretical significance of the results of this study is manifested in the development of approaches for the assessment by practitioners of the harm caused to cooperative associations related to their activities. The work will help to ensure that cooperative actors are poorly protected from various types of negative processes.
