The Crafting of a New Act on the Protection of Cultural Property—The German Case

Abstract

In 2007, Germany finally decided to become a state party to the UNESCO 1970 Convention and to transfer it into the German law. This decision was the starting point of long and heated discussions amongst all stakeholders involved, wrestling for the perfect Act. An evaluation in 2013, however, proved the Act to be a drastic failure and gave way to yet more discussions and debates. In 2016, a new Act, designed to improve upon the original, came into force. This article will examine the different expectations that a modern Act on the Protection of Cultural Property (KGSG in German) has to meet. It will give an overview of most German stakeholders’ perceptions and claims. Against this background, the decisions which were the basis of the 2007 legislation will be examined, focusing on the mistakes that were made and their outcomes. Subsequently, the new Act and its changed focus and prioritisation will be presented, analysing the already-known outcomes and additional expected outcomes. Germany, being a contemporary example of changes in the cultural policy and law, will be presented as a case study, illustrating just how poorly good intentions can be translated into law, but hopefully also what can be learned from experience and which mistakes could be avoided in other countries.
