Zusammenfassung
Jeder in Produktions- und Distributionskette für den Produktfehler Verantwortliche haftet für Schäden, die durch den Produktfehler entstehen, wenn die Kausalität zwischen Produktfehler und Schaden vom Geschädigten bewiesen ist. Die Ausnahme ist ein erfolgreicher Entlastungsbeweis bei nachweislicher Betrachtung aller Pflichten. Die FMEA ist im Bereich Konstruktion und Prozess als Entlastungsbeweis anerkannt und zugelassen, da diese Stand der Technik ist und die Dokumentationspflicht erfüllt.
