Zusammenfassung
Die europäische Integration ist für das „neue deutsche Regierungssystem“ sowohl konstitutiver Bestandteil als auch Rahmenbedingung, nicht zuletzt aber eine latente Herausforderung für seine institutionelle, politische und rechtliche Anpassungsfähigkeit. Angesichts der fortschreitenden Dynamik der Integration, die v. a. eine „Integration durch Recht“ ist, wäre die fortgesetzte Pflege einer „Introvertiertheit der deutschen Rechtsordnung“ ein Anachronismus. Wie offen die Rechtsordnung des deutschen Verfassungsstaates indessen sein kann und darf, darüber lässt sich Einigkeit nur schwer herstellen. Das Bundesverfassungsgericht (BVerfG) ist gleichwohl immer wieder gefordert, hier (autoritativ) Stellung zu beziehen.
