Zusammenfassung
Die freie Verfügbarkeit von Inhalten im Internet über geographische und politische Grenzen hinaus stellt insbesondere liberale Demokratien vor ein Dilemma. Einerseits gilt als Basis einer freiheitlichen politischen Grundordnung die Freiheit der Meinung und des Informationszugangs. Andererseits erfordert die rechtsstaatliche Grundlage eines Gemeinwesens die Durchsetzung der gültigen Rechtsnormen und Gesetze in allen gesellschaftlichen Bereichen und innerhalb des eigenen Territoriums. Denn auch Demokratien stufen entsprechend ihrer eigenen geltenden Normen manche Informationen und Medieninhalte als illegal ein und erlassen gesetzliche Schranken, um ihre Verbreitung zu unterbinden – wie beispielsweise in den Bereichen Jugendschutz oder dem Schutz von Persönlichkeitsrechten. Die geschichtliche Entwicklung der deutschen Regulierungsregime zur Regulierung von Internetinhalten wirft ein Schlaglicht auf die unterschiedlichen Mittel, derer sich demokratische Staatswesen bedienen, und auf die Schwierigkeiten bei ihrer Durchsetzung.

Es bleibt den Mitgliedsstaaten überlassen ob und wie sie Netzsperren einführen.
