Abstract

The chapter outlines the forms and instruments of the ‘horizontal’ cooperation between national judicial and police authorities. The first section is focused on the police cooperation, and it analyses the scope and the functioning of the cooperation instruments (cross-border surveillance, cross-border pursuit, secondment of liaison officers), and in particular the instruments for sharing and exchanging information, in the light of the Prüm Treaty (Decision 2008/615/JHA) and the Schengen Information System (SIS and SIS II). The second section of the chapter concerns the horizontal judicial cooperation, with specific regard to the European Judicial Network (as amended by Decision 2008/976/JHA), the liaison magistrate (Joint Action 96/277/JHA), the joint investigation teams (Framework Decision 2002/465/JHA) and the ‘special investigation techniques’ (controlled handovers and ‘undercover’ operations).
