Abstract
This essay highlights the deep impact different political, social, and economic framework conditions have on the setting of ethical priorities and on the implementation of ethical principles in medicine. It does so by attending to the two Post-Second-World-War German states.
This essay presents an earlier, more complete version of a German summary, published in 2010.

In West Germany the Basic Law, in its §§ 20 and 28 (Grundgesetz, 1949, pp. 3–4), defined the country as a “social state”, thus implicitly entrusting the realization of that ideal to subsequent political decision-making, but avoiding recognition of any specific legal entitlements. The East German constitution, by contrast, offered such a recognition (without, however, supplying resources for individual legal claims in that regard).

It should be noted, though, that the extension of what is covered by the physician’s obligation to details that were not explicitly entrusted to him by the patient (but which the physician learnt in the course of the treatment-relationship) was legalized in the West as early as 1953 (‘Strafrechtänderungsgesetz’ von 1953, 1953, p. 743), while this happened in the East much later, in 1968 (Strafgesetzbuch der Deutschen Demokratischen Republik, 1968, § 136).
