Abstract

All branches of law are constantly under the influence of the social environment, especially national politics and economy, and therefore the author has set the goal of studying the impact of the development processes of the digital economy of the Russian Federation on the Russian criminal law as an important component of cyber security. The authors describe the problems hindering the development of the Russian digital economy, which can be resolved using criminal law instruments. The study revealed the gaps in the Russian criminal law regarding the socially dangerous acts committed with the use of modern information technologies. The paper shows the importance of intersystem relations to the national digital economy and Russian criminal law for lawmaking work and their impact on the effectiveness of the branch. The authors proposed to criminalize some socially dangerous acts committed with the use of modern information technologies, considering the traditions of national lawmaking and the successful experience of the international community and the foreign countries in countering of cybercrimes.
